New Cutting-Edge Topic: Fakes, Forgeries, and the Fight for Truth: Authenticating Digital Evidence in the AI Age

Presentation #1: Cybersecurity and Data Protection: Technical, Legal and Ethical Considerations for Attorneys (and their clients) in Matrimonial Cases

  • Since 2023 all NY attorneys are required to obtain 1.0 CLE credit in Cybersecurity & Privacy Law. The rule was implemented in response to the growing threat of cybersecurity breaches and data privacy violations – and that fact that attorneys and law firms have become prime targets for hackers.  This program will provide a basic understanding of cybersecurity best practices for law firms and attorneys, related data privacy laws and ethical obligations, which will enable them to better protect client information and confidential data. The program will also cover specific situations involving cybersecurity and data protection that frequently arise in matrimonial cases, providing information that will assist them to better advise clients in these situations.  

Presentation #2: Fakes, Forgeries, and the Fight for Truth: Authenticating Digital Evidence in the AI Age

  • In an era where screenshots, texts and emails can be fabricated, audio and video recordings can be convincingly faked with a few clicks, and ‘metadata’ can be easily manipulated, the authenticity of digital evidence is under unprecedented scrutiny. This presentation will educate attorneys as to the most common and pervasive forms of manipulated digital evidence in matrimonial litigation, arm them with insights to identify manipulated digital evidence, challenge that evidence, and ensure what is used in the courtroom is authentic. From deepfakes to fabricated text messages and manipulated metadata, learn how to separate fact from fiction in the digital realm.

Faculty

Timothy Tippins Esq.

Timothy M. Tippins, Esq. is an adjunct professor at Albany Law School and serves on the faculty of the American Academy of Forensic Psychology and on the Affiliate Postdoctoral Forensic Faculty at St. John’s University. He has also served as an Adjunct Professor of Forensic Psychology at Siena College. He is a private practitioner who has engaged in matrimonial and family law practice since 1975 and devotes his practice exclusively to serving as trial counsel and consultant to other family law practitioners on a nationwide basis, with special emphasis on the presentation and cross-examination of expert mental health testimony. Tippins has served in all major professional leadership positions in the New York family law community, including President of the American Academy of Matrimonial Lawyers - New York Chapter, Chair of the NYSBA Family Law Section, and Chair of the NYSBA Task Force on Family Law. Tippins is a regular feature columnist for the New York Law Journal and is the author of the multi-volume treatise New York Matrimonial Law & Practice (West Publishing).

Nick Himonidis Esq.

Nicholas G. Himonidis, JD, CFE, CCFS, CCFI, CRC

President, The NGH Group

With more than 30 years of professional experience in private investigations, computer forensics and law, Mr. Himonidis has participated in, conducted, and supervised thousands of investigations, computer forensic engagements, e-discovery projects, and cryptocurrency and blockchain forensic matters.

He has litigated cases in both state and federal courts, and he has conducted and managed the investigative and e-discovery phases of hundreds of cases. His investigative experience spans financial fraud, including civil RICO claims, insurance fraud, fraudulent claims against the U.S. government, and embezzlement; digital forensics in both cybercrime and “traditional” crimes; and complex, high-profile matrimonial and custody cases.

Mr. Himonidis has written and lectured extensively on e-discovery, digital evidence, cryptocurrency and blockchain forensics, financial investigation, and legal and ethical issues related to expert witnesses. He has been qualified as an expert witness in digital forensics, the authentication of digital evidence and cryptocurrency forensics in state and federal courts, and he has provided countless expert reports on these issues.  In addition, Mr. Himonidis has been appointed by the Supreme Court of New York State as a neutral digital forensic examiner and neutral cryptocurrency forensic expert on numerous occasions. He was appointed to the New York State Bar Association Task Force on Emerging Digital Finance and Currency in 2022 and is the former co-chair of the Nassau County Bar Association Cyber Law Committee.

He is a licensed attorney, a licensed private investigator, a Certified Fraud Examiner, a Certified Computer Forensic Specialist, a Certified Cryptocurrency Forensic Investigator, and holds the Chainalysis Reactor Certification (CRC) credential related to cryptocurrency forensic investigations.

Mr. Himonidis earned a Bachelor of Science degree in criminal justice from St. John’s University, where he graduated cum laude. He graduated from the St. John’s University of Law with a Juris Doctor degree, magna cum laude, finishing in the top 2% of his class.  nhimonidis@theNGHgroup.com
